Terms of Service

Last updated October 17, 2026

These terms are the agreement between you and Arise Digital LLC, which trades as Luovex, for your use of the Luovex software. By opening an account you agree to them.

Who this is for

Luovex is sold to businesses. You must be able to enter a contract on behalf of your studio, and the software is not for use by children.

If you reached this page because a studio you work with uses Luovex, these terms are between us and them, not between us and you. Your relationship is with the studio.

Your account

You are responsible for what happens under your account, including anything your staff and contractors do with the access you give them. Keep your password to yourself, and tell us if you think somebody else has it.

You decide who you invite and what they can see. The software enforces those choices, and a studio owner can review them at any time.

Your clients’ information is yours

Everything you put into Luovex about your clients stays yours. We store and process it so the software works, on your instruction, and we do not use it for anything else. We do not sell it, we do not share it for marketing, and we do not use it to train artificial intelligence or machine learning models.

You are responsible for having the right to put it there. That includes consent to photograph the people in your galleries, consent to email or text the people in your client list, and any release a subject should have signed.

Payment

Paid plans are billed monthly or yearly in advance through Stripe. Yearly plans are charged for ten months and run for twelve.

Moving up a plan takes effect when the payment clears. Moving down takes effect straight away, and the limits of the lower plan apply from that moment. We do not refund part of a period, and we do not charge you for a period you cancel before it starts.

If a payment fails we will try again and tell you. If it keeps failing the account returns to the free plan. Nothing is deleted when that happens: you keep every client, project and file you had, and the limits apply only to adding more.

Prices can change. We will give at least thirty days’ notice by email before a change affects what you pay, and you can cancel before it takes effect.

What a studio’s client pays

Where you use Luovex to take card payments from your own clients, the money goes to your own Stripe account. We never hold it. You pay Stripe at your own rate, and we take nothing from it.

A dispute, a refund or a chargeback on one of those payments is between you, your client and Stripe. We can show you what the software recorded, and that is the extent of what we can do.

Limits

Each plan has limits on clients, storage and people. They are listed on the pricing page and enforced when you try to exceed them, not retroactively. The free plan allows 3 clients.

Allowances for metered features stop when they are spent. They do not run up a bill, and nothing is charged beyond what you have agreed to.

Storage, and what deletion means

Uploaded files are stored by us unless you connect a bucket of your own, in which case they are stored by the provider you chose and we do not control it.

Removing a file sets it aside rather than erasing it immediately. The stored bytes are removed later by a maintenance process which runs no sooner than thirty days afterwards, and a record of the file’s name, size and checksum is kept after the bytes have gone.

Closing your account stops sign-in and hides your workspace. It does not delete anything, and reopening restores access. If you want information actually erased rather than hidden, write to us and we will do it by hand. The Privacy Policy describes this in more detail.

You can export your whole workspace at any time, on any plan, from the billing page. We would rather you left with your data than felt unable to leave.

What we will not host

Do not use Luovex to store or send anything unlawful, anything designed to deceive somebody about who is contacting them, or material depicting the sexual abuse of children. We will remove it and close the account, and where the law requires it we will report it.

Do not use it to send messages to people who have not agreed to receive them.

Suspension

We can suspend an account that is doing one of the things above, that is not paying, or that is damaging the service for other studios. Where the circumstances allow it we will tell you first and give you a chance to fix it. Where they do not, we will tell you afterwards and say why.

Availability

We try to keep Luovex running and we do not promise it always will. There is no uptime guarantee and no service credit. If you need a guarantee of that kind, Luovex is not the right product for you, and we would rather say so here than in a support thread.

Our liability

Luovex is provided as it is. To the extent the law allows, we exclude warranties we have not written down here, and our total liability to you for any claim is limited to what you paid us in the twelve months before it arose. We are not liable for lost profit, lost business or lost data beyond that amount.

Nothing here limits liability that cannot be limited by law.

Not legal advice

Luovex records what happened as accurately as it can and makes the record hard to alter. It does not give legal advice. Whether an electronic signature binds, whether a release is sufficient, and whether a contract says what you meant are questions for a lawyer, not for a CRM.

SMS Terms

This section applies where a studio uses Luovex to send text messages.

The program

A studio using Luovex can send text messages to its own clients about their booking and their account: appointment reminders, notice that an invoice is ready, reminders that a payment is due, and documents waiting for signature. The studio is the sender. Arise Digital LLC, trading as Luovex, delivers the messages on the studio’s behalf.

No marketing or promotional message is sent under this program.

Consent

Messages are sent only to a person who agreed to receive them at the number they gave. Consent is given by ticking an unticked box next to the phone field on a studio’s booking form, and ticking it is never a condition of booking. We record the date, the exact wording shown, and which form it came from.

Frequency

Message frequency varies and depends on the studio’s activity with you. In practice it is a small number of messages around a booking, an invoice or a document, rather than a regular schedule.

Cost

Message and data rates may apply. We do not charge the recipient for a message; your mobile carrier may.

Stopping

Reply STOP to any message to stop receiving them. You will get one confirmation and nothing after it. Reply HELP for help, or contact the studio directly. Stopping is recorded against your number, and asking the studio to stop works the same way.

Carriers

Mobile carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier and your handset and is not guaranteed.

Your information

A mobile number given for this purpose is used for this purpose. We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes. See the Privacy Policy.

Changes to these terms

We will update the date at the top when these terms change, and tell account owners by email when a change materially affects the agreement. Continuing to use Luovex after that means you accept the change.

Ending the agreement

You can stop at any time from the billing page. We can end the agreement on thirty days’ notice, or immediately in the circumstances under Suspension. If we end it other than for those reasons, we will refund the unused part of a period you have paid for.

Governing law

These terms are governed by the laws of the State of North Carolina, and the courts of that state have exclusive jurisdiction over any dispute arising from them.
